1. GENERAL PROVISIONS

These general terms and conditions of sale ("GTC") apply without restriction or reservation to all online sales offered by LOUMY ROLLER SKATES on the website https://www.loumysworld.com. Any order placed implies full and unconditional acceptance of these GTC. By validating the order, the Customer acknowledges having read and accepted them.

The Website is dedicated to the sale of roller skates (also referred to as "rollers," "roller skates," or "roller sneakers"), composed of branded sneakers or shoes (e.g., Nike, Adidas, Puma, etc.), combined with high-quality plates and wheels. Each pair is carefully assembled to offer a unique combination of style, performance, and comfort. Every roller sneaker is a unique piece, either created from existing models or custom-made according to the Client's specifications. Some models may feature exclusive elements such as hand-painted designs or artistic customizations by specialized artists. Products are intended for recreational and artistic use. Although made with durable materials, they must be used according to best roller skating practices. The product offering is regularly updated, and images shown are as accurate as possible. However, due to the handcrafted nature of the assembly and customization, slight variations may occur.

The applicable GTC are those in effect at the time the order is validated. LOUMY ROLLER SKATES reserves the right to amend them at any time by publishing a new version online. These GTC are available for consultation on the website and may be supplemented by specific conditions applicable to certain Products or Services.

These GTC apply exclusively to orders placed by individuals acting as consumers. The Client declares they are of legal age (18+), acting for purposes outside their professional activity, and have full legal capacity to contract. The Client agrees to provide accurate information regarding their identity.

These GTC do not apply to professionals (individuals or entities acting for commercial, industrial, artisanal, liberal, or agricultural purposes). Professionals wishing to place an order must contact hello@loumysworld.com.

2. PRODUCTS

The products sold on the Website are custom-made or non-custom roller skates, crafted on demand.

2.1 PRODUCT SPECIFICATIONS

Prior to ordering, the Client can consult the characteristics of each product on the Website. Each Product is described as accurately as possible.

LOUMY ROLLER SKATES makes every effort to ensure photographic representations are as faithful as possible. However, the Client acknowledges that photographs may not perfectly reflect the Product, and LOUMY ROLLER SKATES shall not be held liable for color, size, or comfort discrepancies. The Client is solely responsible for the intended use of the Product.

Note: Waterproofing is not guaranteed for modified shoes. Clients agree not to alter the Products themselves, failing which they accept full responsibility in case of malfunction or accident.

2.2 PRODUCT AND SERVICE AVAILABILITY

Product offers are subject to availability. Product availability is typically indicated on the product page. Adding a Product to the cart does not guarantee its availability. If a Product becomes unavailable after ordering, LOUMY ROLLER SKATES will inform the Client and offer a substitute. If declined, the unavailable Product will be canceled and refunded, while the rest of the order remains valid.

3. ORDERS

Orders are placed directly on the website. A confirmation email is sent after payment validation.

3.1 ORDER PROCESS

To order a product or customization service, the Client must follow the steps on the site and provide all mandatory information. The Client guarantees the accuracy of the provided information.

3.2 ORDER CONFIRMATION

After submitting an order, the Client receives a confirmation email. LOUMY ROLLER SKATES reserves the right to refuse any order for legitimate reasons.

The Client must ensure the contact details provided are correct and that they can receive the confirmation email. If not received, the Client must contact hello@loumysworld.com.

Order validation and online payment constitute a digital signature and a firm commitment to LOUMY ROLLER SKATES.

4. PRICING AND PAYMENT

Product and Service prices are shown on their respective pages. Prices are displayed in the local currency based on the Client's country. Prices include applicable taxes, except for any customs duties or import taxes specific to the destination country, which remain the Client's responsibility.

For deliveries outside the EU or French overseas territories, prices are exclusive of taxes. Any applicable customs duties or import taxes are the Client's responsibility. Prices charged are those in effect at the time of order validation.

4.1 PAYMENT METHODS

Full payment must be made at the time of order. The Client guarantees they are authorized to use the chosen payment method. LOUMY ROLLER SKATES reserves the right to suspend or cancel orders in case of payment issues or suspected fraud.

Accepted payment methods:

  • Credit card (Visa, Mastercard, etc.)

  • PayPal

  • 3x or 4x installment payments via Klarna or Oney

Payment is debited immediately after order validation.

Discount codes, gift cards, and store credits issued by LOUMY ROLLER SKATES may be used once per order.

5. SHIPPING AND DELIVERY

Roller sneakers are shipped within one week, up to a maximum of three weeks depending on the complexity of the build or customization.

  • International shipping available

  • Tracking email sent upon shipment

  • Shipping fees calculated during checkout

5.1 SHIPPING METHODS

Shipping costs are displayed after entering the delivery address. The Client selects their shipping method and timeframe during checkout.

5.2 RECEIPT

Upon delivery, the Client must check the Product’s condition and completeness. In case of damage or anomaly, the Client must file a claim with the carrier and note any issues on the delivery slip.

6. RETURNS AND REFUNDS

The Client must comply with the following return policy. Under EU law, the Client has 14 days from receipt to exercise their right of withdrawal. However, LOUMY ROLLER SKATES products are made-to-order and permanently modified (e.g., drilling, plate assembly, wheel installation), rendering them unsellable to another Client. Therefore, careful attention is required when ordering (especially size selection).

6.1 RETURN CONDITIONS

Returns are accepted under the right of withdrawal only if:

  • The product is in brand-new condition

  • The product was not used outdoors

  • It was never worn or used

  • All components are returned (shoes, plates, wheels, brakes, screws, etc…)

  • Original packaging and tags are intact

  • No signs of wear

Damaged or incomplete returns may not be refunded fully. A partial refund may apply. As per EU regulation (Directive 2011/83), the right of withdrawal does not apply to custom-made goods.

6.2 RETURN PROCEDURE

To request a return, the Client must email hello@loumysworld.com within 14 days of receipt, including:

  • Order number

  • Reason for return

  • Photos of the product, including:

  • 4 clear photos of the shoes (front, top, side, sole)

  • 4 photos of rolling components (top plate, bottom wheels, left/right profile)

  • Photo of the shipping box

Once accepted:

  • The Client has 7 days to return the item

  • Return shipping is at the Client’s expense

  • Items must be carefully packed to avoid damage

Returns not meeting criteria will be refused and returned at the Client's cost. LOUMY ROLLER SKATES will process returns within 14 days.

6.3 REFUNDS

Refunds are issued within 14 days of receiving and inspecting the return. Refunds are processed via the original payment method, unless technically impossible, in which case a bank transfer may be used at no cost to the Client.

8. MODIFICATION OF TERMS

LOUMY ROLLER SKATES reserves the right to modify these GTC at any time. The version in effect at the time of ordering shall prevail. If any clause is deemed invalid, it shall be considered void without affecting the remaining provisions.

9. WARRANTIES

All products sold on the LOUMY ROLLER SKATES website are covered by the applicable legal warranties, in accordance with French Consumer Law and the Civil Code. These warranties apply exclusively to private customers for personal, recreational, and non-professional use of the Roller Sneakers (roller skates).

9.1 LEGAL WARRANTY OF CONFORMITY (Articles L.217-3 and following of the French Consumer Code)

Customers benefit from a 2-year legal warranty of conformity starting from the date of delivery.

A product is considered non-conforming if it:

  • does not match the description provided at the time of the order

  • has a manufacturing or assembly defect that prevents its normal use

Within 24 months of delivery, any defect reported is presumed to have existed at the time of delivery, unless proven otherwise. In the event of confirmed non-conformity, LOUMY ROLLER SKATES will offer:

  • repair, if feasible

  • or replacement

  • and if neither is possible, a full refund

LOUMY ROLLER SKATES reserves the right to choose the least expensive solution, as allowed by law.

9.2 WARRANTY AGAINST HIDDEN DEFECTS (Articles 1641 and following of the French Civil Code)

In addition to the legal warranty of conformity, customers may also benefit from the warranty against hidden defects, which applies if a serious, hidden defect — not visible at the time of delivery — makes the product unfit for its intended use.

In this case, the customer can choose between:

  • cancelling the sale (full refund)

  • or requesting a partial refund, in accordance with Article 1644 of the Civil Code

This warranty is valid for 2 years from the date the defect is discovered, and the customer must provide evidence of the hidden defect.

9.3 PROCEDURE IN CASE OF DEFECT

If the customer notices a defect, lack of conformity, or hidden flaw, they must contact LOUMY ROLLER SKATES as soon as possible at hello@loumysworld.com, and provide the following:

  • order number

  • clear description of the issue

  • high-quality photos of the product (general and detailed views of the affected area)

Once reviewed, LOUMY ROLLER SKATES may arrange for a return via a selected shipping partner, at no cost to the customer if the warranty applies.

The product must be returned:

  • in its original packaging

  • complete (shoes, plates, wheels, tags, etc.)

  • and unmodified (no disassembly, customization, or repair attempts by the customer)

9.4 WARRANTY LIMITATIONS ANS EXCLUSIONS

The warranty does not cover:

  • normal wear and tear due to use

  • damage resulting from improper, negligent, or non-compliant use, including but not limited to:

  • violent impacts or crashes

  • exposure to water or harsh weather conditions

  • tricks, jumps, stunts, downhill, or skatepark use

  • professional, competitive, or intensive usage not intended for the product

  • any unauthorized modification of the product (e.g. changing wheels, disassembling the plate, personal customization, etc.)

  • defects caused by poor maintenance or improper storage

Any returned product showing clear signs of use, post-sale customization, or intentional damage will be excluded from warranty coverage.

LOUMY ROLLER SKATES reserves the right to conduct a technical assessment or expert review before proceeding with any refund or replacement.

10. DATA PROTECTION

LOUMY ROLLER SKATES, as the data controller, collects personal data (name, address, etc.) necessary for order processing, client management, statistics, and compliance. Data is stored for 5 years from contract end. Failure to provide this data prevents order processing. Data is shared only with third parties involved in payment and delivery.

The Client has the right to:

  • Access

  • Rectify or delete incorrect/outdated data

  • Restrict processing (if justified)

  • Object to data processing (especially marketing)

  • Port data

  • Define post-mortem instructions

  • Withdraw consent (if applicable)

  • File a complaint with the CNIL (France’s data protection authority)

Requests must be made by mail, including full name, email, address, and a copy of a valid ID. LOUMY ROLLER SKATES will respond within 30 days.

11. INTELLECTUAL PROPERTY

Purchasing Products or Services does not transfer any intellectual property rights. All trademarks, domain names, visuals, software, and texts remain the exclusive property of LOUMY ROLLER SKATES.

The Client grants LOUMY ROLLER SKATES the right to use photographs or videos of the customized roller skates on its website and social media.

12. FORCE MAJEURE

LOUMY ROLLER SKATES shall not be liable for failure to perform due to unforeseen circumstances or force majeure. Clients will be informed promptly of such events.

13. LIABILITY LIMITATION

LOUMY ROLLER SKATES is not liable for damage resulting from improper, unsafe, or non-compliant use of its Products.

This includes:

  • Unauthorized modifications

  • Poor maintenance

  • High-risk sports or commercial use

Clients are fully responsible for their use, including injuries or accidents, unless proven manufacturing fault. Products are intended for personal, recreational use only. LOUMY ROLLER SKATES is not liable for lost revenue or indirect damages related to professional use.

14. ACCOUNT SUSPENSION/TERMINATION

LOUMY ROLLER SKATES reserves the right to suspend or terminate any Client account that violates the GTC or applicable laws. Banned users may not reorder or create new accounts without prior approval.

15. APPLICABLE LAW & DISPUTE RESOLUTION

These GTC are governed by French law. In case of dispute, the Client should first contact customer service. If unresolved, the Client may refer to a free consumer mediation service. A list of mediators is available at: https://www.economie.gouv.fr/mediation-conso

The Client may also file a complaint through the EU’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

In the absence of mediation, disputes shall be brought before the competent courts of France.
